§ 1 Information on the Collection of Personal Data

(1) In the following, we provide information about the processing of personal data when using our website. Personal data is all data that can be related to you personally, e.g. name, address, e-mail addresses, user behavior. In this way, we would like to inform you about our processing operations and at the same time comply with the legal obligations, in particular those arising from the EU General Data Protection Regulation (GDPR).

(3) When you contact us by e-mail, via a contact form, telephone or fax, the data you provide (your e-mail address, possibly your name, telephone number or fax number) will be stored by us in order to answer your questions. The purpose of processing this data is to process the inquiry and for communication purposes. We delete the data collected in this context – if the request is assigned to a contract – after the contract period has expired. Otherwise, we delete the data after storage is no longer required, at most three years after the data has been created at the end of the general limitation period or restrict processing if there are statutory retention obligations.

(4) Recipients of personal data / storage duration in general: Recipients of personal data are exclusively those service providers that we use to provide, operate and optimize our website. These include, in particular, hosting providers, technical service providers and providers of analysis and statistical services. The involvement of these service providers takes place either as part of order processing or on the basis of your consent. We adhere to the principles of data avoidance and data economy. Personal data will only be stored for as long as is necessary to achieve the purposes stated in this privacy policy or as required by the statutory retention periods. Unless a more specific storage period is specified in the individual processing operations, the data will be deleted after the purpose has ceased to apply or processing will be restricted if there are statutory retention obligations.

(5) External service providers (processors) and host: We use an external hosting service provider to provide and operate this website. The hosting provider is MOLECO GmbH, Witthagen 2c, 48607 Ochtrup. The personal data collected on this website is processed on the hosting provider’s servers. There is a contract with the hosting provider for order processing in accordance with Art. 28 GDPR, which ensures that personal data is processed exclusively in accordance with our instructions and in compliance with the applicable data protection regulations. The hosting provider does not pass on the data to third parties.

(6) Cookie banner tool: We use the cookie consent tool Borlabs Cookie to manage consents and refusals for services requiring consent. The provider is Borlabs GmbH, Rübenkamp 32, 22305 Hamburg, Germany. Cookies requiring consent and comparable technologies are only used on all pages of our website, including this privacy policy, after your active consent via the cookie banner. No corresponding cookies are set and no external services are loaded before you give your consent or reject them. The cookie banner does not affect the readability of the content of this page. Borlabs Cookie stores the consent decisions you have made in a cookie on your end device in order to take your preferences into account when you visit the site again. Among other things, your consent status, an anonymous ID, the time of consent and technical information about your browser are processed. The processing is carried out to fulfill our legal obligations in accordance with Art. 6 para. 1 lit. c GDPR in conjunction with Art. 7 GDPR and on the basis of our legitimate interest in legally secure documentation of your consent in accordance with Art. 6 para. 1 lit. f GDPR. The storage period is 12 months. You can change or revoke your consent at any time via the cookie banner tool.

§ 2 Your Rights

(1) You have the following rights vis-à-vis the controller with regard to the personal data concerning you: the right to information about the personal data processed by us, the right to rectification of inaccurate data or completion of incomplete data, the right to erasure, the right to restriction of processing, the right to object to processing and the right to data portability, provided that the legal requirements are met. You also have the right to withdraw your consent at any time with effect for the future. The exercise of your rights is free of charge for you. We will respond to requests to exercise your rights without delay, but at the latest within one month of receiving your request. If identification is required, we reserve the right to request suitable evidence. To assert your rights, you can contact the controller or our data protection officer directly at any time.

(2) Right to lodge a complaint with the supervisory authority: You also have the right to lodge a complaint with a data protection supervisory authority about the processing of your personal data by us.

The competent data protection supervisory authority is the State Commissioner for Data Protection and Freedom of Information of North Rhine-Westphalia, Kavalleriestraße 2-4, 40213 Düsseldorf.

§ 3 Processing of personal data when visiting our website (server log files)

When using the website for information purposes, i.e. simply viewing it without registering and without providing us with any other information, we process the personal data that your browser transmits to our server. This information (server log files) includes, for example, the type of web browser, the operating system used, the domain name of your Internet service provider and similar data. The data described below is technically necessary for us to display our website to you and to ensure stability and security and must therefore be processed by us. The legal basis is Art. 6 para. 1 sentence 1 lit. f GDPR.

Typical data collected are:

  • Time zone difference to Greenwich Mean Time (GMT)
  • Content of the request (page visited)
  • Access status/HTTP status code
  • Amount of data transferred in each case
  • Previously visited page
  • Browser
  • Operating system
  • Language and version of the browser software.

Anonymous information of this kind is statistically evaluated by us in order to optimize our Internet presence and the technology behind it.

§ 4 Cookies

We use so-called “cookies”. Cookies are small text files that are transferred from a website server to your hard disk. This automatically provides us with certain data such as IP address, browser used, operating system on your computer and your connection to the Internet. Cookies cannot be used to start programs or transfer viruses to a computer. Using the information contained in cookies, we can make navigation easier for you and enable our web pages to be displayed correctly.

Under no circumstances will the data collected by us be passed on to third parties or linked to personal data without your consent.

You can deactivate the use of cookies at any time via your browser settings. Please note that individual functions of our website may not work if you have deactivated the use of cookies.

§ 5 External Services, Analyses and Advertising (plugins)

We use various external services, plugins and technologies that may involve the transfer of data to third parties (recipients).

5.1 Use of SalesViewer® technology: This website uses SalesViewer® technology from SalesViewer® GmbH to collect and store data for marketing, market research and optimization purposes on the basis of the website operator’s legitimate interests (Art. 6 para. 1 lit. f GDPR). For this purpose, a JavaScript-based code is used to collect company-related data and the corresponding use. The data collected using this technology is encrypted using a non-reversible one-way function (known as hashing). The data is immediately pseudonymized and is not used to personally identify the visitor to this website. The data stored in the context of Salesviewer® is deleted as soon as it is no longer required for its intended purpose and the deletion does not conflict with any statutory retention obligations. 5.2 Google Maps: This website uses Google Maps API to display geographical information visually. When Google Maps is used, Google also collects, processes and uses data about the use of the map functions by visitors. You can find more information about data processing by Google in the Google privacy policy. You can also change your personal data protection settings there in the data protection center. The integration of Google Maps and the associated data processing only takes place with your consent in the cookie banner tool.

5.3 Embedded YouTube videos: We embed YouTube videos on some of our websites. When a YouTube video is started, the provider uses cookies that collect information about user behavior. If you have deactivated the storage of cookies for the Google Ad program, you will not have to expect any such cookies when watching YouTube videos. However, YouTube also stores non-personal usage information in other cookies. Further information on data protection at “YouTube” can be found in the provider’s privacy policy at: https://www.google.de/intl/de/policies/privacy/. The embedding of YouTube videos and the associated data collection only takes place with your consent in the cookie banner tool.

5.4 Google Tag Manager (GTM): This website uses Google Tag Manager, a service provided by Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland. Google Tag Manager is used to manage website tags via an interface. The Google Tag Manager itself does not process any personal user data and does not set any cookies. It merely triggers other tags, which in turn may collect data. Google Tag Manager does not access this data. If other services are integrated via the Google Tag Manager, these are described separately in this privacy policy. The Google Tag Manager is only used with your prior consent via the Cookie Banner Tool. The legal basis for the processing is Art. 6 para. 1 lit. a GDPR.

5.5 Google Analytics: This website uses Google Analytics, a web analytics service provided by Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland. Google Analytics uses cookies to help the website analyze how users use the site. The information generated by the cookie about your use of this website is usually transmitted to a Google server and stored there. We have activated IP anonymization. This means that your IP address will be shortened by Google within the member states of the European Union or in other contracting states of the Agreement on the European Economic Area. Only in exceptional cases will the full IP address be transmitted to a Google server in the USA and truncated there. Google processes this information on our behalf in order to evaluate the use of the website, compile reports on website activity and provide other services related to website activity and internet usage. Google Analytics is only used with your express consent via the cookie banner tool. The legal basis is Art. 6 para. 1 lit. a GDPR. 5.6 Google Ads: We use Google Ads, an online advertising service provided by Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland. We use conversion tracking as part of Google Ads. If you access our website via a Google ad, Google Ads will set a cookie on your device. These cookies lose their validity after a certain period of time and are not used for personal identification. The cookies allow Google to recognize that a user has clicked on an ad and has been redirected to a specific page. Each Google Ads customer receives a different cookie. Cookies can therefore not be tracked via the websites of Google Ads customers. The information collected using the conversion cookie is used to compile conversion statistics. We only learn the total number of users who have clicked on an ad. No information is transmitted with which users can be personally identified. Google Ads is only used with your consent via the cookie banner tool. The legal basis is Art. 6 para. 1 lit. a GDPR. Consent can be revoked at any time via the cookie banner tool.

Supplement for 5.2 to 5.6: When using the services of Google Ireland Limited, personal data may be transferred to servers of Google LLC based in the USA. For these cases, the provider has provided suitable guarantees within the meaning of Art. 46 GDPR, in particular the conclusion of EU standard contractual clauses. Nevertheless, it cannot be ruled out that US authorities may access the transmitted data. The use of the aforementioned services takes place exclusively with your express consent via the cookie banner tool in accordance with Art. 6 para. 1 lit. a GDPR.

5.7 Matomo: This website uses the web analysis service Matomo. The IP address is anonymized before it is saved so that it cannot be directly linked to a person. Cookies are only used if you have consented to this via the cookie banner tool. Matomo is used to analyze and regularly improve the use of our website. The data collected is used exclusively for this purpose and is not passed on to third parties.

Data is not transferred to third countries. Matomo is only used with your prior consent via the cookie banner tool. The legal basis for processing is Art. 6 para. 1 lit. a GDPR. You can revoke your consent at any time with effect for the future via the cookie banner tool.

5.8 Font Awesome: Fonts and icons from the Font Awesome service are used on this website. They are integrated via a locally installed WordPress plugin. The provider is Fonticons Inc, 6 Porter Road, Apartment 3R, Cambridge, MA 02140, USA. The local integration means that no connections to external Font Awesome servers are established when our website is accessed. No personal data is transmitted to the provider. Font Awesome is used in the interest of a uniform and appealing presentation of our website. The legal basis is Art. 6 para. 1 lit. f GDPR.

§ 6 SSL Encryption

To protect the security of your data during transmission, we use state-of-the-art encryption methods (e.g. SSL) via HTTPS.

§ 7 Amendment of our Data Protection Provisions

We reserve the right to amend this privacy policy from time to time so that it always complies with current legal requirements or to implement changes to our services in the privacy policy, e.g. when introducing new services. The new privacy policy will then apply to your next visit.

§ 8 Processing of Applicant Data

We process personal data of applicants for the purpose of carrying out the application process. In particular, we process contact data, application documents, proof of qualifications and other data that you provide to us as part of your application.

The processing is carried out to decide on the establishment of an employment relationship. The legal basis is Art. 6 para. 1 lit. b GDPR in conjunction with § 26 BDSG. If you give us your consent to store your application data for a longer period of time, the processing is also carried out on the basis of Art. 6 para. 1 lit. a GDPR. Your application data will only be processed by the persons responsible for the application process. It will not be passed on to third parties.

After completion of the application process, your data will be deleted after six months at the latest, unless there are statutory retention obligations or you have expressly consented to longer storage.
